These Terms & Conditions ("Terms") are a binding agreement between you and Quickie App, LLC ("Quickie," "we," "us") governing your use of the Quickie app and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility (13+)
You must be at least 13 years old to use Quickie. By using the Service you represent and warrant that you are 13 or older and that the information you provide, including your date of birth, is accurate. Quickie may not be used by anyone under 13. If we learn that an account belongs to someone under 13, we will close it and delete its data.
If you are between 13 and 17, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf. A parent or guardian who wants an account closed can email quickie.app.email@gmail.com.
Your date of birth is set once, at signup, and cannot be changed from within the app. Giving a false date of birth — in particular to present yourself as an adult or to avoid the protections in section 6 — is a violation of these Terms and grounds for termination.
2. Your account
Your account is tied to your verified phone number. You are responsible for activity on your account and for keeping access to your phone number and device secure. If you lose access to your phone number, you may lose access to your account. Display names are not unique; your phone number is your identity.
3. The Service
Quickie lets you place and receive one-to-one video calls that are capped at 60 seconds and end automatically. You can find friends who use Quickie and invite people who do not. If a call is not answered or is declined, the caller can leave the recipient a photo taken in the app, with an optional short message; only people on the recipient’s Quickie Friends list can leave one, and the recipient can view it once. Features may change over time.
4. Coins
The Service may include virtual "coins." Coins are a free, in-app feature with no real-world or monetary value. Coins cannot be purchased, sold, traded, transferred, exchanged, or redeemed for money or anything of value, inside or outside the app. Coins are used only to unlock cosmetic changes during a call and serve no other purpose. Coins are not your property: we may modify, revoke, reduce, or remove coins (or the coin feature itself) at any time, for any reason, without notice or compensation, including when your account is suspended, terminated, or deleted.
5. Acceptable use
You agree not to:
- Use the Service to harass, threaten, abuse, stalk, or harm anyone.
- Share content that is unlawful, sexually exploitative of minors, hateful, violent, or that infringes others' rights.
- Direct sexual content, sexual advances, or sexually suggestive conversation at anyone you know or believe to be under 18, or attempt to arrange an in-person meeting with a minor you do not know. We report suspected child sexual exploitation to the appropriate authorities.
- Misrepresent your age, in either direction, to reach or gain the trust of another user.
- Expose others to nudity or sexual content without consent, or engage in any illegal conduct.
- Send spam or unwanted invitations, or use the Service to send bulk or automated messages.
- Attempt to record, capture, or redistribute another person's call without their consent.
- Reverse engineer, disrupt, overload, or attempt to gain unauthorized access to the Service or its infrastructure.
- Impersonate any person or misrepresent your affiliation.
We have zero tolerance for objectionable content and abusive behavior. Violations may result in immediate suspension or termination.
6. Safety: blocking, reporting, and users under 18
You can block other users and report content or behavior that violates these Terms. We review reports and may remove users who violate these Terms. We aim to act on reports of objectionable content and abusive users promptly. Repeated reports against an account automatically suspend it pending review, and profile names, status messages, and profile photos are screened automatically, with anything flagged raised to our team for review. Photos and messages sent after an unanswered or declined call are not screened automatically; they are reviewed when a recipient reports one.
Accounts whose date of birth is under 18 get additional protections:
- They start on “Contacts only,” so only people they have saved can call them. This can be changed in Settings.
- They are not shown the feature for calling the Quickie team — the only feature that offers a call to someone who is not already one of your contacts.
- When they report another user, that report is flagged and sent directly to our team for review.
We have zero tolerance for the sexual exploitation of minors and for adults who use the Service to contact minors they do not know. Accounts found doing either are terminated permanently.
7. Calls are not recorded
Quickie does not record your calls. You agree not to use third-party tools to record other participants without their consent, which may also be illegal where you live.
8. Invitations and messaging
Invitations are sent by you, from your own device, using your phone's Messages app. When you invite someone, you confirm you have a relationship with that person and are responsible for the message you send. Standard message and data rates may apply. Do not use invitations to send spam.
9. User content
You retain ownership of the content you provide (such as your display name, your profile photo, and any photo or message you send after an unanswered or declined call). You grant us a limited license to host, transmit, and display that content as needed to operate the Service, including delivering it to the recipient you chose and reviewing it if it is reported. You are responsible for the content you provide and must have the rights to it.
10. Third-party services and devices
The Service relies on third-party providers (including Apple, and providers for messaging, data, and call relay) and on your device and network. We are not responsible for those services or for connectivity issues outside our control. Your use of Apple-provided software is also subject to Apple's standard end-user license terms.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY CALL WILL CONNECT.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, QUICKIE AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
13. Indemnification
You agree to indemnify and hold harmless Quickie and its operators from any claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms.
14. Termination
You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users.
15. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in New York, New York will have exclusive jurisdiction over any dispute arising from these Terms or the Service, and you consent to personal jurisdiction there.
16. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance.
